C3 Comedy Terms of Service
OVERVIEW
This online store is operated by Aesthetic Engine Pty Ltd trading as C3 Comedy (“C3 Comedy”, “we”, “us” or “our”).
These Terms of Service apply when you access or use the C3 Comedy online store or purchase products through it. Our store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products.
By using the store or placing an order, you agree to these Terms of Service and the policies referred to in them.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
1. Products
C3 Comedy currently offers digital products, including downloadable digital artwork. We may also offer physical merchandise or other products in the future.
We make reasonable efforts to describe and display our products accurately. Colours and appearance may vary depending on your screen, device, printer, printing process or other equipment.
We may change, discontinue or limit products at any time.
2. Digital Products and Licence
Digital products are supplied electronically and no physical product will be shipped unless the product description specifically states otherwise.
Unless expressly stated otherwise, purchasing C3 Comedy digital artwork gives you a limited, non-exclusive licence to use the downloaded file for personal, non-commercial use only.
You must not resell, redistribute, sublicense or commercially exploit the digital file or make it available to others for download.
Purchase of a digital product does not transfer ownership of any copyright or other intellectual property rights in the artwork.
3. Physical Products
If C3 Comedy offers physical merchandise, those products may be manufactured, supplied or shipped by third-party fulfilment partners.
Any product-specific production, delivery, return or replacement information will be provided with the relevant product or order where applicable.
C3 Comedy remains responsible for providing any remedies required by applicable consumer law. We will not require a customer to pursue a manufacturer or fulfilment provider instead of C3 Comedy where the law places that responsibility on us.
4. Orders and Payment
By placing an order, you offer to purchase the selected product at the displayed price.
Orders are subject to successful payment processing and acceptance by C3 Comedy. We may decline or cancel an order where reasonably necessary, including where there has been a pricing or product error, suspected fraud or other problem affecting the transaction.
You are responsible for providing accurate billing, payment and contact information.
Prices are displayed in the currency shown at checkout. Any taxes, charges or other amounts applicable to an order will be displayed or calculated where required.
5. Refunds and Problems With Products
Purchases are subject to our Return and Refund Policy.
We do not provide refunds or exchanges simply because a customer changes their mind, unless otherwise stated for a particular product.
If a product is faulty, defective, materially different from its description or otherwise fails to meet applicable consumer guarantees, remedies will be provided as required by the Australian Consumer Law and other applicable consumer protection laws.
These rights apply to online purchases just as they do to other consumer purchases.
6. Intellectual Property
Unless otherwise stated, the C3 Comedy store and its original content, including C3 Comedy branding, text, graphics, artwork, video, audio and original product designs, are owned by or licensed to Aesthetic Engine Pty Ltd and are protected by applicable intellectual property laws.
Nothing in these Terms transfers ownership of C3 Comedy intellectual property to you.
Names, trademarks, images or other material belonging to third parties remain the property of their respective owners. Their appearance on or in connection with C3 Comedy content does not imply sponsorship, approval or endorsement unless expressly stated.
7. Acceptable Use
You must not use the store:
- for unlawful or fraudulent purposes;
- to interfere with or compromise the security or operation of the store;
- to infringe the rights of C3 Comedy or another person;
- to distribute malicious software or harmful code; or
- to obtain, reproduce or exploit store content in a manner that violates these Terms or applicable law.
We may restrict access where reasonably necessary to protect the store, our customers or our rights.
8. Third-Party Services
Our store uses services provided by third parties, including Shopify and payment, analytics or fulfilment providers.
Those services may be subject to their own terms and privacy policies.
C3 Comedy is powered by Shopify, but purchases from the C3 Comedy store are transactions between you and C3 Comedy. Shopify is the ecommerce platform provider and is not the seller of C3 Comedy products.
9. Privacy
Personal information collected through the store is handled in accordance with our Privacy Policy and applicable privacy laws.
Shopify and other service providers may process information as necessary to provide ecommerce, payment and related services.
10. Liability and Consumer Rights
To the maximum extent permitted by law, C3 Comedy is not liable for losses that are not reasonably foreseeable or that result from circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or other rights or remedies where doing so would be unlawful.
Where the Australian Consumer Law applies, your rights under that law continue to apply regardless of anything else stated in these Terms. The ACCC specifically warns businesses against terms that purport to remove consumer-guarantee rights or responsibility for reasonably foreseeable losses caused by a failure to meet those guarantees.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes to our store, products, services or legal requirements.
The current version will be made available through the C3 Comedy store. Changes will apply from the date the updated Terms are published, except where applicable law requires otherwise.
12. Governing Law
These Terms are governed by the laws applicable in Queensland, Australia.
Nothing in this section limits any rights you may have under applicable consumer protection laws.
